Terms of Service

1. Who these terms apply to

Campate is a software-as-a-service product of Exciton Technologies LLP for educational institutions. Campate is the product name, and Exciton Technologies LLP is the legal entity that provides, operates, and contracts for the service.

These terms apply to institutions, administrators, staff, and authorised users who access or use Campate.

2. Institutional responsibility

The institution is responsible for configuring Campate, authorising users, maintaining accurate student and contact records, and ensuring that attendance, notification, and reporting workflows comply with applicable laws and institutional policies.

3. Acceptable use

Users must not misuse Campate, attempt unauthorised access, upload unlawful content, interfere with service availability, or use attendance and contact data for purposes unrelated to legitimate institutional administration.

4. Communications

Campate may support SMS, email, WhatsApp, Telegram, or similar notification channels. Institutions are responsible for ensuring they have a lawful basis and required consents or notices before sending communications to students, parents, guardians, staff, or other contacts.

The institution is responsible for collecting, recording, and maintaining valid consent, opt-in, notice, and contact-preference records before using Campate to send communications. This includes any consent required from parents, lawful guardians, students, staff, or other recipients, and any opt-in required by WhatsApp, SMS, telecom, or similar messaging rules.

Campate sends operational communications based on institutional configuration and instructions. To the maximum extent permitted by law, Campate is not responsible for an institution's failure to obtain, maintain, update, or prove valid consent, or for inaccurate, outdated, unauthorised, or unlawfully collected contact details supplied by the institution.

Institutions must promptly update Campate records when a recipient withdraws consent, opts out, changes contact details, raises a complaint, or should no longer receive communications.

5. Payments and billing

Campate is a paid SaaS platform. Paid plans, invoices, refunds, online payments, subscription renewals, taxes, and recurring billing are governed by the commercial terms agreed with the institution and any applicable order form, invoice, or subscription plan.

Payment processing may be handled by third-party payment gateways, payment aggregators, banks, or other regulated payment service providers. Gateway terms, refund timelines, settlement rules, failed-payment handling, dispute processes, taxes, KYC, fraud checks, and compliance checks may apply.

6. Suspension, restriction, and termination

We may suspend, restrict, or terminate access to Campate, in whole or in part, where we reasonably believe it is necessary due to non-payment, unauthorised access, security risk, platform misuse, unlawful use, breach of these terms, breach of third-party communication or payment platform policies, or risk to students, institutions, users, or the service.

We may also suspend, restrict, remove, preserve, disclose, or disable access to data, accounts, messages, links, or functionality where required or permitted by applicable law, a court order, government or regulatory direction, law-enforcement request, payment-provider requirement, messaging-platform requirement, or other legally valid process.

7. Service changes and availability

We may improve, modify, suspend, or discontinue parts of Campate. We aim to maintain reliable access, but we do not guarantee uninterrupted or error-free service.

8. Data protection

Personal data handling is described in our Privacy Policy. Institutions must use Campate in a manner consistent with the Digital Personal Data Protection Act, 2023, applicable rules, and any other laws that apply to their operations.

Institutions act as Data Fiduciaries for personal data they determine the purposes of when using Campate. Exciton Technologies LLP processes such data to provide the service and acts as Data Fiduciary for platform account, security, billing, and related operational data as described in the Privacy Policy. Institutions must not use Campate to process personal data unlawfully or without required notices, consents, or other lawful bases.

9. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to any mandatory legal requirements that cannot be excluded, courts and competent forums at Kottayam, Kerala will have jurisdiction over disputes or proceedings arising from or relating to Campate, these terms, or the use of the platform.
